Filing 6 ORDER: Plaintiff Jhery Jones, an inmate at Cook County Jail, initiated this pro se civil rights complaint pursuant to 42 U.S.C. 1983. Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to immediately deduct $5.25 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. However, Plaintiff's complaint #1 is dismissed without prejudice for failure to state a claim. If Plaintiff wants to proceed with this lawsuit, he must submit an amended complaint that states a federal claim against proper defendants. Failure to submit an amended complaint by August 29, 2023, will result in dismissal of this lawsuit for failure to state a claim. Should Plaintiff submit an amended complaint, he must also update the Court on the status of his underlying criminal case by the date set forth above. Plaintiff also is advised that he must promptly submit a change-of-address notification if he is transferred to another facility or released. If Plaintiff fails to keep the Court informed of his address, this action will be subject to dismissal for failure to comply with a Court order and for failure to prosecute. The Clerk of Court is directed to send Plaintiff an amended complaint form and instructions along with a copy of this order. Plaintiff's motion for attorney representation #4 is denied without prejudice. Signed by the Honorable Franklin U. Valderrama on 8/1/2023. Mailed notice. (kp, ) |
