Filing 5 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to immediately deduct $4.36 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order (100% of Plaintiff's income - this includes gifts, prison payroll, settlements, etc. - when it meets statutory minimums, must be devoted toward his filing fees). The Court directs the Clerk of Court to (1) send a copy of this order to the trust fund officer at Dixon Correctional Center and to the Court's Fiscal Department. However, summonses shall not issue. Plaintiff's motion showing good cause why the court should allow his time barred complaint to go forward #4 is denied. Plaintiff's complaint #1 is dismissed for failure to state a claim because it is time barred on its face. In addition, the Court finds that the complaint is frivolous in light of the obvious and conceded time bar. This dismissal counts as a dismissal under 28 U.S.C. 1915(g).
