Fuentes: This matter coming before the magistrate judge on referral (doc. #10 ) for discovery supervision, the Court has reviewed the parties' status report (doc. #8 ) and the discovery schedule set by the district court (doc. #9 ) stands, with the fact discovery cutoff set at 3/29/24. The parties are further directed to review the Court's Standing Order for Civil Cases Before Magistrate Judge Fuentes and the Top Ten Ways to Defeat Settlement, both available on the Court's website. A further joint written status report is due by noon on 1/25/24 concerning discovery progress (and any proposed expert discovery schedule). On review of the status report, R. 8, the parties appear to dispute whether supplemental jurisdiction applies over the state law wage claims. The Plaintiff shall file a Jurisdictional Memorandum in support of jurisdiction on 08/25/2023. The defense shall respond on 09/08/2023. The Plaintiff may reply on 09/15/2023. The Court notes that if the Plaintiff is a citizen of Illinois (not just "residing" in Illinois, R. 1, para. 5), and if the amount in controversy on the state law claims is over $75,000, then diversity jurisdiction might apply. (2.) Meanwhile, discovery shall commence. Rule 26(a)(1) disclosures due 08/25/2023. The first round of written discovery requests must be issued by 09/15/2023. Rule 16(b) deadline to add parties or amend pleadings is 01/29/2024. **No summary judgment motion may be filed before the close of fact discovery without prior authorization of the Court.** Discovery supervision is referred to the magistrate judge (including the authority to add and to adjust all deadlines).
