Filing 7 MINUTE entry before the Honorable Franklin U. Valderrama: Plaintiff Mohammad Al Azzah filed this mandamus action on 7/12/2023, initiated by the filing of a complaint signed by attorney Sam A. Odeh of Odeh Law Group. #1 Although the Complaint was signed by Attorney Odeh, it contained several handwritten corrections which appear to have been initiated by Plaintiff. Plaintiff also filed a pro se appearance form #4 . On 9/6/2023, Plaintiff filed a letter, which appears to have been sent by Attorney Odeh to the USCIS Field Office and contains a copy of the filed Complaint #6 . Under Federal Rule of Civil Procedure 11(a), every pleading "must be signed by at least one attorney of record in the attorney's name-or by a party personally if the party is unrepresented." Here, based on the filing of Plaintiff's pro se appearance, the Court understands that Plaintiff is representing himself. Therefore, his Complaint must be signed by Plaintiff himself, rather than his former attorney. By 9/21/2023, the Court directs Plaintiff to file an amended Complaint that he has personally signed, if he is indeed representing himself in this case. If, on the other hand, Plaintiff intends to be represented by counsel, Attorney Odeh must file an appearance in this case so that he may be counsel of record. Any such appearance must be filed by 9/21/2023. After an amended complaint or attorney appearance is filed, the next step is service. For every Defendant named in the complaint, Plaintiff must (a) present a summons that complies with Federal Rule of Civil Procedure 4(a) to the clerk for signature and seal and (b) serve the issued summons and complaint (or amended complaint) upon Defendants consistent with Rule 4(i). Plaintiff is put on notice that Rule 4(m) requires the Complaint to be served within 90 days of it being filed unless the court finds good cause to extend the date.
