August 16, 2023 Filing 22 MINUTE entry before the Honorable Jeffrey Cole: The defendants filed a motion that discovery be stayed until such time as the District Court has ruled on the pending Defense's Motion To Dismiss. Fundamental fairness requires that the plaintiff be given an opportunity to respond to the motion. Or as stated differently, I ought not rule on the motion #20 , until the plaintiff has had an opportunity to respond. "Audi alteram partem - hear the other side! - a demand made insistently through the centuries, is now a command, spoken with the voice of the Due Process Clause of the Fourteenth Amendment, against state governments, and every branch of them - executive, legislative, and judicial - whenever any individual, however lowly and unfortunate, asserts a legal claim." Caritativo v. People of State of California, 357 U.S. 549, 558 (1958). This, of course, applies to federal litigation as well. The plaintiff shall have until 9/6/23 to respond, and the defendant shall have until 9/13/23 to reply.
