Filing 6 MINUTE entry before the Honorable Thomas M. Durkin: Plaintiffs bring this suit alleging claims in violation of the "FTC Fraud & Scam Reduction Act and other laws of the Constitution" and request to proceed in forma pauperis and for attorney representation. This Court must screen all complaints accompanied by an application to proceed in forma pauperis and dismiss a complaint that is "frivolous or malicious, fails to state a claim on which relief may be granted, or seeks monetary relief against a defendant who is immune from such relief." 28 U.S.C. 1915(e)(2)(B); see also Hutchinson v. Spink, 126 F.3d 895, 899 (7th Cir. 1997) (recognizing the applicability of 1915 to cases brought by non-prisoners). Plaintiffs' complaint fails to state a claim. The Fraud and Scam Reduction Act, 15 U.S.C. 58, does not create a private right of action. And Plaintiffs' allegation that Defendant violated "other laws of the Constitution" does not provide Defendants with adequate notice of the nature of Plaintiffs' claims against them and their entitlement to relief. See Fed. R. Civ. P. 8(a). Therefore, Plaintiffs' complaint #1 is dismissed without prejudice, and Plaintiffs may file an amended complaint by or before August 18, 2023. Plaintiffs' requests to proceed in informa pauperis and for attorney representation #4 are denied as moot. Mailed notice. (ecw, ) |
