Filing 32 NOTICE of APPEAL. Modified on 9/26/2023 (psm, ). |
Filing 31 MINUTE entry before the Honorable Manish S. Shah: The motions #25 #26 #28 and #29 are denied. In federal court, we do not have a "substitution of judge" procedure like the one in state court. Disagreement with how a judge ruled on a case is not basis to disqualify a judge in federal court. In this case, the court remanded this lawsuit back to state court because there is no federal jurisdiction over the state-law eviction case. Plaintiff seeks reconsideration of that decision, but does not point to any new information or manifest error. Plaintiff's belief that the decision to remand was a violation of her rights is not a reason to reconsider the ruling. Nothing in plaintiff's recent filings demonstrates that there is federal jurisdiction over her eviction case. Plaintiff has another lawsuit pending in federal court, and nothing in this case prevents her from pursuing remedies in that case or in state court. This case is closed. Plaintiff must now stop filing motions under this case number that repeat what she has already presented. Instead, she must seek relief from another court that has jurisdiction over her claims. Notices mailed. (psm, ) |
