September 11, 2023 Opinion or Order Filing 11 MINUTE entry before the Honorable LaShonda A. Hunt: The Court has reviewed the parties' joint status report of 9/1/23 #10 . Defendant indicated that it plans to file a motion to dismiss pursuant to Fed. R. Civ. P. 12(b)(6). However, motions to dismiss must be filed before responsive pleadings. Fed. R. Civ. P. 12(b). And the responsive pleading in this case was due on 8/8/23, 7 days after the notice of removal #1 was filed on 8/1/23. See Fed. R. Civ. P. 81(c)(2)(C) (Because Citibank was served with the Complaint and Summons on 7/5/23, the "longest of the[] periods" listed in Rule 81(c)(2) is "7 days after the notice of removal [was] filed"). At this point, Defendant could be deemed in default for its failure to respond to Plaintiff's complaint. See Fed. R. Civ. P. 55(a). However, the Court will, on its own instance, extend the time for Defendant to respond to the complaint to 9/15/23. No further extensions will be granted. The telephonic status hearing set for 9/12/23 is stricken. The parties are strongly encouraged to discuss resolution of this matter on their own and to notify Judge Hunt's courtroom deputy if at any time they would like a referral to the Magistrate Judge for a settlement conference.
