Filing 17 MINUTE entry before the Honorable Franklin U. Valderrama: Before the Court are several motions filed by Plaintiff, including (1) a motion for attorney representation #9 , (2) a motion to deny attorney representation #12 , (3) a motion for an emergency hearing #13 , (4) a motion for appeal of full custody #14 , and (5) a motion to bring all evidence and witnesses to trial #15 . Based upon Plaintiff's request to deny attorney representation, the Court denies Plaintiff's motion for attorney representation #9 and grants Plaintiff's request to deny attorney representation #12 . With respect to the remaining motions, as this matter does not have an operative complaint, the Court enters and continues those motions, and the Court will review and rule upon those motions after receipt of an Amended Complaint compliant with this Court's Minute Entry #16 . Filing 16 MINUTE entry before the Honorable Franklin U. Valderrama: The Court has reviewed Plaintiff's Amended Complaint #8 . Plaintiff filed this lawsuit using the form Complaint for Violation of Constitutional Rights available on the Court's Online Forms webpage, however, Plaintiff only included the first page of that form. The remaining pages of the Amended Complaint are a form Complaint for the United States Court of Federal Claims. This jurisdiction is the Northern District of Illinois and is not the United States Court of Federal Claims, and the Court cannot accept that form complaint. As previously explained, Plaintiff also filed a petition to proceed in forma pauperis #4 . Pursuant to 28 U.S.C. 1915(a)(1), any person may commence a civil action without the prepayment of fees if he or she is unable to pay them. The Court must screen all complaints accompanied by an application for leave to proceed in forma pauperis, and it must dismiss a complaint that "is frivolous or malicious, fails to state a claim on which relief may be granted, or seeks monetary relief against a defendant who is immune from such relief." 28 U.S.C. 1915(2)(B)(i)(iii); see Hutchinson v. Spink, 126 F.3d 895, 899 (7th Cir. 1997) (recognizing the applicability of 28 U.S.C. 1915 to cases brought by non-prisoners). Courts screen complaints under 1915 in the same manner they review motions to dismiss under Federal Rule of Civil Procedure 12(b)(6). Maddox v. Love, 655 F.3d 709, 718 (7th Cir. 2011). Based on Plaintiff's Amended Complaint #8 , the Court cannot evaluate the sufficiency of the Complaint under 1915, and the Court dismisses Plaintiff's Amended Complaint without prejudice, with leave to refile by 09/29/2023 using the complete Complaint for Violation of Constitutional Rights form available at the Northern District of Illinois' webpage for online forms: https://www.ilnd.uscourts.gov/OnlineForms. The Court directs Plaintiff's attention to the U.S. District Court Hibbler Memorial Pro Se Assistance Program, information about which can be found at: https://www.ilnd.uscourts.gov/Pages.aspx?/2+UWDbtVzCDq3Lu8BusuQ== or 312-435-5691. Failure to file an amended and completed Complaint by 09/29/2023 may result in dismissal of this action with prejudice for failure to prosecute. Given the Court's dismissal of Plaintiff's complaint without prejudice, the Court enters and continues Plaintiff's in forma pauperis petition #4 , and the Court will review and rule upon that petition after receipt of Plaintiff's amended complaint.
