Filing 7 ORDER: The Court grants Plaintiff's motion to proceed in forma pauperis #5 and authorizes and orders the trust fund office at Plaintiff's place of incarceration to deduct $13.92 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. However, summonses shall not issue at this time. The complaint #1 is dismissed for failure to state a claim. Plaintiff is given until October 23, 2023 to submit an amended complaint that cures pleading deficiencies in his current complaint. Failure to do so will result in dismissal of this case. The Court directs the Clerk to: (1) send a copy of this order (electronically, if possible) to Plaintiff's trust fund officer and to the Court's Fiscal Department; and (2) mail Plaintiff a copy of this order, an amended civil rights complaint form, instructions, and a blank USM-285 (Marshals Service) form.
