Gottschall: Plaintiff has filed a motion #6 to reassign this case under Local Rule 40.4 as related to multi-district litigation pending before Chief Judge Pallmeyer, In re Abbott Laboratories, et al., Preterm Infant Nutrition Products Liability Litigation, No. 22-cv-71 (N.D. Ill.) (MDL No. 3026). In substance, plaintiff argues in her motion #6 that this case is a potential tagalong action. Local Rule 40.3(b)(6) provides, "Where a civil case is filed as a potential tag-along action to a multidistrict litigation ('MDL') proceeding pending in the district, it shall be assigned directly to the judge handling the MDL proceeding." Accordingly, the court grants plaintiff's motion #6 to reassign this case but does so under Local Rule 40.3(b)(6).
