August 15, 2023 Filing 8 MINUTE entry before the Honorable Lindsay C. Jenkins: On review of the complaint, R. 1, the Court issues this subject matter jurisdiction inquiry. The complaint states that Plaintiff has (or had) three bank accounts with JP Morgan Chase and that the bank is in "violation of insurance FDIC" due to compromised savings account and 2 checking accounts." The complaint states that police reports were made, and claims were made to the Bank, and that the Bank committed a breach of contract. Federal courts are courts of limited jurisdiction. On the Court's review, there is no apparent basis for federal subject matter jurisdiction because no federal law claim is asserted, nor is there any indication that there is diversity among the parties even if Plaintiff seeks to bring a breach of contract claim. Nor does the $250,000 FDIC insurance limit that applies to banks give this Court jurisdiction over Plaintiff's claim. The Plaintiff must submit a Jurisdictional Statement explaining the basis for federal subject matter jurisdiction by September 15, 2023, or else the case will be dismissed without prejudice. August 15, 2023 Filing 7 MINUTE entry before the Honorable Lindsay C. Jenkins: Plaintiff's motion for leave to proceed in forma pauperis #4 is denied without prejudice to refiling. The Court has compared the application Plaintiff filed in this case on August 11, 2023 #4 to the application she filed in Case No. 23-cv-1218 on March 16, 2023 [23-cv-1218 DE 12.] The application filed in March 2023 states that Plaintiff's last date of employment was April 2020 and that the last monthly take-home pay was $940 per month. The application filed in the case before this Court on August 11, 2023 states that the date of Plaintiff's last employment was September 2017 and that the monthly take home pay was $280 per month. #4 . Plaintiff also lists an amount of unemployment/public assistance/welfare that is $100 more than the amount she listed in March 2023. The Court also notes that the Complaint #1 describes three bank accounts Plaintiff has (or had) at JP Morgan Bank, but none of those accounts are listed in the application. It is certainly possible that some of the information provided in the applications may have changed between March and August 2023, but Plaintiff has represented to this Court that her date of last employment is nearly two and a half years earlier than the date she represented to Judge Valderrama in Case No. 23-cv-1218. Plaintiff is reminded that all filings, including applications to proceed in forma pauperis, most be truthful and accurate and that the documents are signed under penalty of perjury. The application states "I declare under penalty of perjury that all of the information listed above is true and correct. I understand that a false statement may result in dismissal of my claims or other sanctions." Mailed notice. (jlj, )
