October 2, 2023 Filing 10 MINUTE entry before the Honorable Edmond E. Chang: (1.) On review of the status report, R. 7, the Court sets the following discovery schedule. Rule 26(a)(1) disclosures due 11/02/2023. The first round of written discovery requests must be issued by 11/02/2023. = Fact discovery, including any treating health care providers (if any), must be completed by 05/02/204. Rule 26(a)(2)(C) summaries for treating health care providers (if any) must be disclosed 75 days in advance of the fact discovery deadline, and adjusts with any general extension of fact discovery deadline. = Rule 16(b) deadline to add parties or amend pleadings is 03/04/2024. By 04/01/2024, the parties shall file a Deposition Scheduling Report listing the depositions already taken and (more importantly) the remaining deponents, all of whom must have ***confirmed*** deposition dates (not just proposed dates). Any person not on that Report will presumptively not be deposed without good cause (e.g., genuine surprise despite due diligence). If deponents are slow in confirming deposition dates, the parties should use the Report deadline to urge each other and non-parties to provide confirmed dates to avoid a motion to compel in advance of the deadline. The deadline to serve subpoenas is 03/11/2024, absent good cause (e.g., genuine surprise despite due diligence). The retained-expert schedule will be set later. (2.) On the anticipate partial motion to dismiss Count 3 (state law unlawful detention), the opening brief is due on 11/13/2023 (which is the current answer deadline; if the defense wishes to file earlier, then the Court will move up the briefing schedule). The Plaintiff's response is due on 12/11/2023. The defense reply is due on 12/23/2023. (3.) The status report says that there have been no settlement discussions at all. The Court also orders a settlement exchange. Plaintiffs to make a formal settlement demand by 10/18/2023. Defendants to respond by 11/01/2023. On 11/01/2023, counsel for Defendants to email copies of the demand and response to this Court's proposed order email box. (4.)
