ORDER: Petitioner's motion to stay this case #3 is denied without prejudice. He may file another motion to stay addressing the issues discussed in this order. Alternatively, he may choose to proceed with his current 2254 petition or file an amended one that includes the unexhausted claims and attempt to overcome the procedural default. By December 1, 2023, Petitioner must file either another motion to stay or an amended petition. His failure to do so will result in this Court conducting its initial review of the original petition without considering his request to stay or any new claims he seeks to add to his current 2254 claims. | Filing 5 MINUTE entry before the Honorable Manish S. Shah: Petitioner Marlon Coleman has submitted a 28 US.C. 2254 petition to challenge his conviction from St. Clair County, Illinois. #1 . He also seeks to stay this case while he exhausts state court remedies for some of his claims. #3 . Before this Court can address either of these filings, Petitioner must satisfy the $5.00 filing fee requirement. His letter to the Court #4 states that he could not submit payment until his case was opened and a case number was assigned. This case having been opened and assigned a case number, Petitioner must now either: (1) pay the $5.00 fee by check or money made payable to Clerk, United States District Court for the Northern District of Illinois; or (2) submit a completed in forma pauperis (IFP) application with a certificate section signed by an authorized officer at his facility and with a copy of his prison trust account. The Clerk of Court is directed to send to Petitioner an IFP form. Petitioner's failure to comply with this order by 10/11/23, will result in summary dismissal of this case without prejudice. See N.D.
