ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders Plaintiff (and his trust fund officer) to pay $16.70 as an initial partial filing fee. The trust fund officer at Plaintiff's place of incarceration is authorized and ordered to make further deductions in accordance with this order as set forth below. The Court directs the Clerk of Court to: (1) file the complaint #1 ; (2) send a copy of this order (electronically, if possible) to Plaintiff's trust fund officer and to the Court's Fiscal Department; (3) issue summons for service of the complaint on Defendant Bannua by the U.S. Marshal; and (4) send Plaintiff a blank USM-285 (Marshals service) form, filing instructions, and a copy of this order. The Court appoints the U.S. Marshal to serve Defendants. Plaintiff must complete and return USM-285 forms for service on Defendants. Failure to return the USM-285s by November 27, 2023, may result in dismissal of unserved Defendants, as well as dismissal of this case in its entirety. Plaintiff must promptly submit a change-of-address notification if he is transferred to another facility or released. If Plaintiff fails to keep the Court informed of his address, this action will be subject to dismissal for failure to comply with a Court order and for failure to prosecute.
