Filing 10 MINUTE entry before the Honorable Matthew F. Kennelly: The Court dismissed pro se plaintiff Finas Townsend's original complaint because it could not make out the factual or legal basis for a viable claim. The Court directed Townsend to file an amended complaint. Townsend did so and appears to asserts claims of (perhaps among other things) gender and race discrimination. The problem at this point is that Townsend has alleged only legal conclusions and no supporting facts. The Court gave Townsend until 10/10/2023 to file a further amended complaint using a court-supplied form (which the Clerk send to Townsend) but nothing has been filed. The Court dismisses Townsend's amended complaint for failure to state a viable claim due to the complete lack of supporting factual allegations. Unless Townsend files by 11/6/2023 a proper amended complaint using the court-supplied form the Court will enter judgment dismissing the case with prejudice. Mailed notice. (mma, ) |
Filing 9 MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff Finas Townsend III has filed an amended complaint as directed by the Court. The Court thanks Mr. Townsend for his amended complaint. Mr. Townsend alleges that he was employed by defendant Euromarket Designs Inc. through November 2022 and experienced discrimination based on gender and race. Now that it is apparent that Mr. Townsend is asserting a claim of employment discrimination there is a different court-adopted complaint form that he needs to use. The form is tailored to employment discrimination cases and seeks certain particular items of information relevant to cases of that type. This includes whether and when the plaintiff filed an administrative claim of employment discrimination with the federal Equal Employment Opportunity Commission and/or the Illinois Department of Human Rights. The Court directs the Clerk to send plaintiff an amended complaint form for employment discrimination cases. Plaintiff is directed to file an amended complaint using that form. Filing 7 MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff's application to proceed in forma pauperis #4 is granted because plaintiff is shown he is unable to prepay the filing fee. The Court has reviewed plaintiff's complaint under 28 USC 1915(e)(2) to determine if it is frivolous or fails to state a claim upon which relief may be granted. The Court concludes that the current complaint fails to state a discernable claim. Federal Rule of Civil Procedure 8(a)(2) requires a plaintiff to provide "a short and plain statement" of the plaintiff's claim. The complaint in this case is anything but a "short and plain statement." It consists of a collection of narratives; copies of emails and other communications; documents; photographs; and other materials. The Court cannot make out from this the factual basis or legal basis for the plaintiff's claim. The Court therefore dismisses the complaint with leave to amend. The Clerk is directed to send plaintiff an amended complaint form for employment discrimination claims. Plaintiff is given until 10/4/2023 to file an amended complaint that states at least one viable claim for relief over which the Court has jurisdiction. Plaintiff should take care to comply with the "short and plain statement" requirement of Rule 8(a)(2) and should describe directly and succinctly both the factual and legal basis for his claim. If plaintiff does not file a viable amended complaint by the due date the Court will enter judgment against him. Mailed notice. (mma, ) |
