Filing 15 PETITION for writ of habeas corpus filed by Mark A Gierczak against John D. Idleburg. (Envelope not postmarked). (jn, ) |
Filing 13 ORDER: Petitioner's motion for leave to proceed in forma pauperis #12 is denied. As the Court's October 2, 2023, order #10 explained, Petitioner's September 25, 2023, letter #9 stated that he had $240.30 in his trust fund account at that time. That is sufficient to pay the five-dollar filing fee for this case, and the Court's order instructed Petitioner to pay the fee by October 23, 2023. The instant IFP application, which contains a copy of Petitioner's trust fund ledger, once again confirms he has sufficient money to pay the fee. The deadline established by the Court's October 2, 2023, order remains in effect. Signed by the Honorable Robert W. Gettleman on 10/11/2023. Mailed notice (cn). |

Filing 11 LETTER from Mark Gierczak dated 09/28/2023; Exhibits. (lw, ) |
Filing 10 ORDER: Petitioner Gierczak has written a five page letter to the Court addressing multiple issues. #9 He is advised that it is improper to contact the Court via a letter. Requests for relief should be made via a motion filed with the Court. Any future letters will be disregarded by the Court. Regarding the contents of the letter, Petitioner claims he has $240.30 in his trust fund account. [9 at 5] Petitioner can pay the five dollar fee and so must do so by October 23, 2023. Failure to pay the fee by that date will result in dismissal of this case. Petitioner's letter requests the Court issue an order instructing jail officials to submit his filing fee. The proper protocol is for Petitioner to submit a payment request of his jail officials via the jail's established procedures. His check for the filing fee should be sent to the Clerk of Court, United States District Court for the Northern District of Illinois, 20th Floor, 219 S. Dearborn, Chicago, IL 60604. Petitioner should make sure his case number is on the check submitted by jail officials on his behalf. Petitioner asks for appointment of counsel in his letter. He must make the proper motion. The Clerk shall send Petitioner a blank appointment of counsel form. Signed by the Honorable Robert W. Gettleman on 10/2/2023. Mailed notice (cn). |
