Filing 6 MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff Michael Bivens filed a lawsuit in state court against a federal government agency (the US Copyright Office). The government removed the case to federal court under 28 USC 1442 and then filed a motion to dismiss. The Court ordered plaintiff to respond to the motion to dismiss by 10/13/2023. Plaintiff did not do so and did not seek an extension of time. The Court dismisses the case without prejudice for lack of subject matter jurisdiction. Federal jurisdiction in this situation depends on whether the state court (where plaintiff filed the case) had jurisdiction. See e.g. Minnesota v. United States; 305 U.S. 382 (1939). The state court lacked jurisdiction because under the Federal Tort Claims Act a lawsuit of this type against a federal government agency may be filed only in federal court in the first instance. If plaintiff wishes to sue the Copyright Office he must initiate his lawsuit in federal court. The Court expresses no view regarding the merits of any such future claim. For the reasons stated the Court directs the Clerk to enter judgment as follows: The case is dismissed without prejudice for lack of jurisdiction. Civil case terminated. Mailed notice. (mma, ) |
