November 9, 2023 Filing 34 MINUTE entry before the Honorable Nancy L. Maldonado: The Court is in receipt of a letter from Plaintiff #33 , in which he requests that Defendants provide information about their relationship with certain unidentified persons who Plaintiff suspects of criminal activities and harassment. The Court advises Plaintiff, as it did in its previous 10/17/2023 minute order #30 , that this civil lawsuit is not a proper forum for Plaintiff to raise criminal complaints, and those issues should be presented to law enforcement. Further, this Court will not order Defendants to take any actions such as produce documents and information at this time, given that there is a pending motion to dismiss and a pending motion to remand. This case will not proceed until the Court resolves the pending motions, which it will endeavor to do in due course. (ca, )

October 17, 2023 Filing 30 MINUTE entry before the Honorable Nancy L. Maldonado:The Court has reviewed Plaintiff's motion to enter a protective and restraining order #16 . Although the motion is somewhat difficult to parse, it appears that Plaintiff is alleging that Defendant, and other unnamed individuals associated with Defendant, are engaged in ongoing wrongful conduct towards Plaintiff, including harassment and threats. The Court need not address the merits of the allegations as Plaintiff is attempting to raise claims of alleged criminal conduct which should be presented to and considered by law enforcement authorities. These allegations do not support the issuance of any protective or restraining order in this civil case, in which Plaintiff raises claims of discrimination. Any claims of criminal conduct should be presented to law enforcement. Plaintiff's motion is improper for the additional reason that it does not explain the scope of his proposed restraining order and the specific conduct he is seeking to restrain. In sum, the allegations in Plaintiff's motion do not support the issuance of a protective or restraining order. The motion #16 is therefore denied. The Court reminds Plaintiff that he has a deadline of 10/31/2023 to file any reply in support of his motion to remand. #13 . Defendant's reply in support of its motion to dismiss is due 10/18/2023. September 22, 2023 Filing 10 MINUTE entry before the Honorable Nancy L. Maldonado: The Court has received several emails from Plaintiff Gray to the courtroom deputy, in which he (1) disputes the representations of Defense counsel that he would not agree to a proposed briefing schedule on the motion to dismiss; (2) attaches several pleadings purportedly filed with the Circuit Court of Cook County objecting to removal; and (3) attaches a cease and desist letter he claims Defendant has not responded to. Plaintiff is advised that he should not be sending the Court's courtroom deputy any substantive communications about his case, nor attaching court filings to emails. All substantive communications with the Court or evidence or documents associated with Plaintiff's claims must be filed on the docket, and communications with the courtroom deputy should be limited to logistical issues such as scheduling of hearings or briefing schedules. Additionally, the Court notes that it appears Plaintiff has only filed his objections to removal (and request for remand) on the state court docket. This is improper, and requests to remand this federal case back to state court must be presented to the federal court. Until that time, the Court has entered a briefing schedule on the motion to dismiss. If Plaintiff requires more time to respond to the motion to dismiss, or to file a motion to remand, he can file a motion on the docket requesting an extension. The Court refers Plaintiff to the Court's September 21, 2023 order for more details. September 21, 2023 Filing 9 MINUTE entry before the Honorable Nancy L. Maldonado: The Court is in receipt of Defendant Walgreens' motion to dismiss #7 . Defense counsel emailed the Court's courtroom deputy stating that Plaintiff Gray would not agree to their proposed briefing schedule. The email contains a communication from Plaintiff indicating that he had submitted objections to Defendant's notice of removal, but the Court has not received any such filing from Plaintiff. In any event, based on the Court's initial review of the Notice of Removal #1 , it appears this Court has subject matter jurisdiction, as the case includes federal claims under Title VII, the ADA, and the ADEA. The parties should therefore proceed with briefing on the motion to dismiss. The Court adopts Defendant's proposed schedule as follows: Plaintiff's response to the motion to dismiss is due October 11, 2023; Walgreens' reply is due October 18, 2023. As Plaintiff is pro se and has not yet filed an appearance on the docket, Defense counsel is directed to send Plaintiff a copy of this minute order via email. Plaintiff should promptly file a pro se appearance form on this Court's docket so that he may receive electronic notice of all Court orders and filings. If Plaintiff believes removal to this federal court was improper (notwithstanding the fact that the Court appears to have jurisdiction), he may promptly file an objection to removal (called a motion to remand) explaining why he believes removal is inappropriate, which the Court will review and consider. If Plaintiff files such an objection to removal, the Court will consider modifying the motion to dismiss briefing schedule.
