Other screenshots in that document are of plush toys that are sold using the mark, which also don't fall under the mark's int'l classes of 9, 16, and 25. The plaintiff is granted leave to file, by 10/19/2023, either (i) a supplemental brief under seal of no more than 5 pages explaining how the various products that are depicted throughout the Exhibit 2 actually do fall within the international classes for the asserted marks, or (ii) an amended complaint, Schedule A, and/or exhibit 2 that assert only colorable infringement claims. Any amended exhibit 2 should include a chart identifying which screenshots correspond to which defendant and which mark is allegedly being infringed by each defendant.
