Kocoras:This case was transferred to the undersigned when it became evident that it was merely a refiling of Case No. 23-cv-5090, which this Court previously dismissed twice for lack of subject matter jurisdiction. Like Plaintiff's complaints in Case No. 23-cv-5090, Plaintiff's multiple complaints in this case [1, 20] contain only criminal allegations against Defendant and again fail to establish subject matter jurisdiction. Plaintiff's complaint is therefore dismissed without prejudice for lack of subject matter jurisdiction. Plaintiff is not granted leave to amend, and no further filings will be entertained. ORDER: The plaintiff's application for leave to proceed in forma pauperis #3 is denied without prejudice. The plaintiff's complaint includes copies of bank account statements showing $1,210.04 in monthly child support payments, while the form indicates that the plaintiff has no dependents and is subsisting solely on $257 in monthly public assistance. Accordingly, by 11/4/23, the plaintiff is directed to either pay the full statutory filing fee of $402.00 or file a second application to proceed without prepaying fees that explains this discrepancy and fully identifies all sources of funds and assets.
