Under Rule 4(m) of the Federal Rules of Civil Procedure, if a defendant "is not served within 90 days after the complaint is filed, the courton motion or on its own after notice to the plaintiffmust dismiss the action without prejudice against that defendant or order that service be made within a specified time." Plaintiff is reminded that under Rule 4(m), it has until 12/27/2023 to file proof of service. Accordingly, the status hearing set for 12/21/2023 is reset for 1/24/2024 at 9:30 AM. ORDER signed by the Honorable John F. Kness on 10/12/2023: Telephonic initial status hearing is set for 12/21/2023 at 9:30 AM.
