October 10, 2023 Filing 5 MINUTE entry before the Honorable John F. Kness: Before the Court is Plaintiff Esther Zepeda's application #4 to proceed in this case without prepaying the filing fee. Plaintiff identifies as her only income $368 per month from her current employer and $220 per month in unspecified public assistance. Plaintiff identifies as her only assets $364 in a bank account. In view of these limited means, Plaintiff asserts that she is forced to "ask for gifts and donations and loans from my family and friends to survive." (Dkt. 4 at 2.) Yet Plaintiff has not identified either the amounts or frequency of those gifts, even though the Court-approved form asks for that information (Plaintiff's response was "0"). Plaintiff has not explained how she is paying for the necessities of life (such as food, telephone service, transportation, or her substantial mortgage payment) for herself. Accordingly, the Court denies Plaintiff's application #4 as incomplete without prejudice to filing a renewed application. Any renewed application must address the concerns noted above by providing specifics about all of Plaintiff's income, including gifts, and by explaining how she is otherwise paying for the necessities of life. The renewed application must be filed on or before 10/30/2023; in the alternative, Plaintiff may pay the required filing fee. If Plaintiff does not address the filing fee issue (see 28 U.S.C. sec. 1914) on or before 10/30/2023, either by submitting a renewed IFP application or by paying the fee, this case will be subject to dismissal without further warning. Plaintiff is advised that she may obtain the free limited assistance of counsel by scheduling an appointment with the William J.
