Filing 21 MINUTE entry before the Honorable Manish S. Shah: The citizenship of an LLC is determined by the citizenship of its members. To establish diversity jurisdiction, the party asserting jurisdiction must identify the citizenship of each of the LLC's members (and if those members have members, the citizenship of those members as well). See Thomas v. Guardsmark, LLC, 487 F.3d 531, 534 (7th Cir. 2007). The parties' status report and plaintiffs' complaint do not allege the citizenship of the members of the defendant LLC. Plaintiffs' response to the motion to dismiss is due 12/29/23 and defendants' reply is due 1/26/24. The court will rule by cm/ecf. Discovery is stayed because the court is not convinced it has subject-matter jurisdiction based on the parties' failure to properly allege citizenship. Notices mailed. (psm, ) |
