Filing 8 MINUTE entry before the Honorable Rebecca R. Pallmeyer: In an order dated October 25, 2023, the court directed Plaintiff Nellya Britvich to pay the court's filing fee or submit an application for leave to proceed without prepayment. The court also noted a concern about its jurisdiction: Ms. Britvich has alleged that she was defrauded, but it appears that the court lacks jurisdiction over her state law fraud claim because the parties are not diverse in citizenship. Finally, the court noted that there was no apparent reason for filing of this case under seal. On November 6, 2023, Ms. Britvich submitted another document under seal, including copies of the court's previous order and of various police reports, together with several handwritten pages that appear to be in the Russian language. Ms. Britvich has not yet paid the filing fee. Her complaint #1 and petition #3 are dismissed without prejudice for this reason. Ms. Britvich may seek reconsideration of the court's ruling within 30 days, but any motion for reconsideration must be written in the English language and must be accompanied by payment of the filing fee or a motion for leave to proceed without prepayment. Ms. Britvich is again advised that disputes between two or more residents of the same state must be filed in state court, not in federal court. As she has not yet established a reason this case should be filed under seal, the Clerk is directed to place her most recent submission #7 in the public record. Civil case terminated. Mailed notice.
