On October 16, 2023, Petitioners Hartford HealthCare Corporation, Hartford Hospital, Hartford HealthCare Medical Group, Inc., and Integrated Care Partners, LLC's ("Hartford") filed a motion to compel Subpoena Respondent Press Ganey Associates, LLC ("Press Ganey) to produce documents. (R. 1.) The court ordered Press Ganey to file a response to the motion to compel by November 27, 2023. (R. 13.) Press Ganey did not file a response, and the motion remains unopposed. Nevertheless, this court is still obligated to ensure that Hartford took "reasonable steps to avoid imposing undue burden or expense" on Press Ganey before granting the motion. Fed. R. Civ. P 45(d)(1). Upon examination of the record though, this court questions whether the Northern District of Illinois ("NDIL") is the proper district to pass judgment on this particular subpoena issue. According to Hartford's subpoena (R. 4-6), Press Ganey is located in Indiana, and the motion does not include facts showing that NDIL is the district where Press Ganey's compliance is required.
