October 30, 2023 Filing 3 MINUTE entry before the Honorable Edmond E. Chang: Steven Davis is a detained at the Will County Adult Detention Facility. He filed this lawsuit without pre-paying the $402.00 filing fee or filing an application to proceed in forma pauperis. The Prison Litigation Reform Act requires that all inmates pay the filing fee. 28 U.S.C. 1915(b)(1). If an inmate cannot pay the full $402.00 filing fee upfront, he may seek to proceed in forma pauperis (in other words, leave to pay the fee over time with monthly installments taken from his trust fund account; in that instance, the filing fee is $350.00 as an administrative fee is waived). The Court evaluates 12 months of financial information to determine if an inmate is eligible to proceed in forma pauperis. If so, then the Court calculates the initial partial filing fee using a trust-fund certification and the inmate's trust fund ledgers from the past six months, both of which an inmate must submit with his application. See 28 U.S.C. 1915(a)(2). Thus, if the Plaintiff wants to proceed with this case, then he must submit a properly completed in forma pauperis application that accurately discloses his income and assets for the past year. He must include a certified copy of his trust fund statement showing activity in his account for the six months immediately preceding the filing of his complaint (from around 04/16/2023 through10/16/2023, or as much of that period as he was detained). Alternatively, the Plaintiff may pay the full statutory filing fee of $402.00. Payment should be sent to the Clerk of Court, United States District Court, 219 South Dearborn Street, Chicago, Illinois 60604, attn: Cashier's Desk, 20th Floor, and must clearly identify the Plaintiff's name and the case number assigned to this case. The in forma pauperis application or the fully payment of the fee are due by 11/20/2023. Failure to comply with this order by the deadline will result in dismissal of this action. The Clerk of Court is directed to send Plaintiff an in forma pauperis (prisoner version) application and a copy of this order.
