Specifically, the plaintiff has not shown that there is diversity of citizenship among the parties because it fails to allege defendant Kontos's citizenship. The complaint merely sets forth his residence, which is inadequate. An individual's citizenship is based on the state in which he is domiciled (which may differ from the state of residence).
