December 28, 2023 Filing 9 ANNUAL REMINDER: Pursuant to #Local Rule 3.2 (Notification of Affiliates)#, any nongovernmental party, other than an individual or sole proprietorship, must file a statement identifying all its affiliates known to the party after diligent review or, if the party has identified no affiliates, then a statement reflecting that fact must be filed. An affiliate is defined as follows: any entity or individual owning, directly or indirectly (through ownership of one or more other entities), 5% or more of a party. The statement is to be electronically filed as a PDF in conjunction with entering the affiliates in CM/ECF as prompted. As a reminder to counsel, parties must supplement their statements of affiliates within thirty (30) days of any change in the information previously reported. This minute order is being issued to all counsel of record to remind counsel of their obligation to provide updated information as to additional affiliates if such updating is necessary. November 2, 2023 Filing 7 MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff has filed a lawsuit along with an application to proceed in forma pauperis (in other words without prepaying the filing fee). The Court grants the motion to proceed in forma pauperis #4 because plaintiff has shown that he is unable to pay the filing fee. Any request for appointment of counsel is denied without prejudice because plaintiff has not filed that request using the proper form and also because plaintiff has not shown what he has done (if anything) to try to file counsel on his own. The Court has also reviewed plaintiff's complaint under 28 USC 1915(e)(2) to determine if it states a viable legal claim. Plaintiff appears to assert a claim of national origin discrimination. The narrative section of the complaint is just one sentence long: plaintiff has he "has been pressured into working past 60 hours a week until he got sick from working and could not show up for work then was terminated." There are no facts alleged that would tend to support a claim of national origin discrimination. The Court dismisses the complaint for that reason. Plaintiff is given until 11/27/2023 to file an amended complaint. If plaintiff does not file by that date an amended complaint that includes at least one viable claim the Court may dismiss the case in its entirety. The Court also notes that if plaintiff is attempting to sue under Title VII of the Civil Rights Act of 1964 for national origin-based discrimination he typically must first file a charge of discrimination with the Equal Employment Opportunity Commission and await the EEOC's disposition of that charge before filing a lawsuit in court. It does not appear that plaintiff has filed an EEOC charge at this point. Plaintiff may be able to proceed in court under 42 USC 1981 without filing a charge with the EEOC but it not clear whether he has a viable claim under 42 USC 1981 either.
