Date Filed Document Text
December 28, 2023 Filing 5 ANNUAL REMINDER: Pursuant to #Local Rule 3.2 (Notification of Affiliates)#, any nongovernmental party, other than an individual or sole proprietorship, must file a statement identifying all its affiliates known to the party after diligent review or, if the party has identified no affiliates, then a statement reflecting that fact must be filed. An affiliate is defined as follows: any entity or individual owning, directly or indirectly (through ownership of one or more other entities), 5% or more of a party. The statement is to be electronically filed as a PDF in conjunction with entering the affiliates in CM/ECF as prompted. As a reminder to counsel, parties must supplement their statements of affiliates within thirty (30) days of any change in the information previously reported. This minute order is being issued to all counsel of record to remind counsel of their obligation to provide updated information as to additional affiliates if such updating is necessary. If counsel has any questions regarding this process, this #LINK# will provide additional information. Signed by the Executive Committee on 12/28/2023: Mailed notice. (tg, )
November 3, 2023 Filing 4 MINUTE entry before the Honorable Sharon Johnson Coleman: Under 28 U.S.C. 1915(e)(2), the Court can review a pro se plaintiff's claims to determine whether the action she alleges is frivolous or malicious, fails to state a claim on which relief may be granted, or if it is seeking damages from a defendant who is immune. 28 U.S.C. 1915(e)(2)(B)(i)- (iii); see Jones v. Bock, 549 U.S. 199, 214, 127 S.Ct. 910, 166 L.Ed.2d 798 (2007) (grounds for sua sponte dismissal set forth in 28 U.S.C. 1915(e)(2)(B)). The Court has "the authority to dismiss a claim based on an indisputably meritless legal theory, but also the unusual power to pierce the veil of the complaint's factual allegations and dismiss those claims whose factual contentions are clearly baseless." Neitzke v. Williams, 490 U.S. 319, 327 (1989). Here, the Plaintiff fails to assert a basis for her claims, and if so, it is unclear to the Court what the Plaintiff is alleging. The Plaintiff asserts that she was disappointed in the Defendants' actions of embarrassing, harassing, stalking, and possibly attempting to murder her. The Plaintiff further states that her father, Michael Jordan, and mother attempted to steal $100,000 worth of checks from her. However, the Plaintiff fails to state in which ways the Defendants' committed such acts or which laws she brings her claims under. The Court concludes that the Plaintiff's lawsuit is frivolous because it lacks an arguable basis in either fact or law. See Denton v. Hernandez, 504 U.S. 25, 31 (1992); Johnson v. Stovall, 233 F.3d 486, 489 (7th Cir. 2000). Consequently, the Plaintiff's application for in forma pauperis #3 is denied. The Plaintiff may amend her compliant by December 3, 2023. Mailed notice.
