November 1, 2023 Filing 5 MINUTE entry before the Honorable Franklin U. Valderrama: Upon review of the complaint, the Court makes the following jurisdictional inquiry. Plaintiff premises jurisdiction on the diversity jurisdiction, 28 U.S.C. 1332. Plaintiff alleges that both Burger King Corporation and Burger King Company LLC's citizenship for diversity jurisdiction is their respective place of incorporation and principal place of business. R. 1 4-9. But an LLC's citizenship is not like a corporation's; instead an LLC is a citizen of every state where its members are citizens. Wise v. Wachovia Securities, LLC, 450 F.3d 265, 267 (7th Cir. 2006). Accordingly, on or before 11/15/2023, Plaintiff should either file an amended complaint fixing these problems as to Defendant Burger King Company LLC's citizenship, or otherwise file a memorandum explaining why the current complaint sufficiently alleges jurisdiction.
