Filing 9 MINUTE entry before the Honorable Nancy L. Maldonado: The Court has received Cahill's application to proceed in forma pauperis [4, 5] and Cahill's Complaint #1 . Cahill's application to proceed in forma pauperis is granted. His Complaint, however, is dismissed with prejudice for lack of subject matter jurisdiction. Under 28 U.S.C. 1915 (e)(2), the Court is required to screen the complaint of a plaintiff who is proceeding in forma pauperis, and the Court must dismiss their complaint if it determines that the complaint "is frivolous or malicious; fails to state a claim on which relief may be granted; or seeks monetary relief against a defendant who is immune from such relief." 28 U.S.C. 1915 (e)(2)(B)(i)(iii). Cahill seeks payment ($99 billion dollars) for past contractual agreements with the United States government and various federal agencies. In his Complaint, Cahill states that the Tucker Act, 28 U.S.C. 1491, is the basis of jurisdiction for this case. The Tucker Act, however, vests exclusive jurisdiction in the United States Court of Federal Claims over contract claims brought against the United States that exceed more than $10,000. See Burks v. U.S. Postal Serv., No. 08 C 5869, 2009 WL 1097508, at *3 (N.D. Ill. Apr. 17, 2009) (citing 28 U.S.C. 1491(a)(1); 28 U.S.C. 1346(a)(2)). The United States Court of Federal Claims is a separate federal court that hears private claims against the United States government. Cahill will therefore need to first follow the procedure laid out in the Contract Disputes Act, and, if applicable, file his complaint in the United States Court of Federal Claims. This Court currently does not have the authority to hear his claim. Therefore, Plaintiff's Complaint #1 is dismissed with prejudice for lack of subject matter jurisdiction. Civil case terminated.
