Filing 5 MINUTE entry before the Honorable Lindsay C. Jenkins: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court defers ruling on Plaintiff's motion for attorney representation #4 until Plaintiff complies with this order. The Court orders the trust fund officer at Plaintiff's place of incarceration to immediately deduct $1.93 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. The Court directs the Clerk of Court to send a copy of this order (electronically if possible) to the trust fund officer at the facility having custody of Plaintiff and to the court's fiscal department. Summonses, however, shall not issue on Plaintiff's complaint #1 , which is dismissed without prejudice. Plaintiff is given until February 2, 2024, to (1) submit an amended complaint and (2) show cause in writing why his action should not be dismissed as untimely. Failure to comply in full with both of these directives will result in dismissal of this case without prejudice. Alternatively, Plaintiff may attempt to refile his claims in state court. The Clerk of Court is directed to send Plaintiff an amended complaint form and instructions along with a copy of this order. Mailed notice. (jlj, ) |
