Filing 6 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at plaintiff's place of incarceration to deduct $4.17 from plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. The Court directs the Clerk of Court to send (electronically if possible) a copy of this order to the trust fund officer at plaintiff's current place of incarceration and to the Court's Fiscal Department. Summons, however, shall not issue at this time. Plaintiff's complaint #1 is dismissed without prejudice for failure to state a federal claim. Failure to submit a proposed amended complaint consistent with this order by January 11, 2024 will result in entry of judgment against Plaintiff. The Clerk is directed to send plaintiff a copy of this order and a blank amended complaint form. Plaintiff's motion for attorney representation #4 is denied without prejudice.
