Chang: On review of the notice of removal, the state court complaint, and the Defendant's motion #7 to dismiss, the Plaintiff's response to the dismissal motion is due on 12/26/2023. The defense reply is due on 01/13/2024. In the response, the Plaintiff shall address whether she agrees that federal subject matter jurisdiction applies under (a) complete preemption (the Court surmises that the Plaintiff would not so agree); (b) diversity jurisdiction (the parties are of diverse citizenship, but the Plaintiff should address the jurisdictional minimum); (c) CAFA, 28 U.S.C. 1332(d) (again addressing the jurisdictional minimum); and (d) any other basis. The defense reply brief shall address any jurisdictional issues raised by the Plaintiff. The Plaintiff may use 20 pages for the response brief. The motion hearing of 11/30/2023 is vacated. The initial tracking status hearing is set for 01/12/2024 at 8:30 a.m., but to track the case only (no appearance is required, the case will not be called). The parties shall file the joint initial status report by 01/05/2024, using the attached template.
