| Filing 12 MINUTE entry before the Honorable Franklin U. Valderrama: The Court has reviewed Plaintiff's notice of filing of stipulation of dismissal filed in the U.S. District Court for the Eastern District of Louisiana, Civil Case No. 2:17-cv-14458 ("Notice") #11 . Pursuant to the Notice, as well as the attached "Stipulation of Dismissal with Prejudice as to All Defendants" ("Stipulation") [11-1] the Court understands that Plaintiff sought voluntary dismissal of her case in the Eastern District of Louisiana before the case was transferred to this District. The Stipulation states that "[p]ursuant to Fed. R. Civ. P. 41(a)(ii) and PTO No. 87, all parties who have appeared stipulate to the dismissal of the present action with prejudice, with each party to bear its own costs." Because the stipulation is signed by Plaintiff's counsel only, the Court understands that Stipulation to in fact be a notice of dismissal seeking to dismiss the case pursuant to Fed. R. Civ. P. 41(a)(2). The Court accordingly orders that this action is dismissed as to all Defendants with prejudice and with each party to bear its own costs. Civil case terminated. If the Court's understanding of the Notice and Stipulation is incorrect, the parties are directed to file a status report on the docket no later than 12/6/2023. Emailed notice (axc). |
