Counsel reported that they have conferred: the government will provide records to corroborate that Defendant DiMaggio was acting within the scope of federal employment, and counsel shall promptly confer and file a motion for a protective order. If the Plaintiff is not convinced, then the response to the motion to dismiss is due on 03/06/2024. The government's reply is due on 03/20/2024. More likely, however, the parties shall file a stipulated dismissal without prejudice. A tracking status hearing is set for 03/08/2024 at 8:30 a.m. to track the case only (no appearance is required, the case will not be called). January 11, 2024 Filing 11 MINUTE entry before the Honorable Edmond E. Chang: The Plaintiff's unopposed extension motion to respond to the dismissal motion does not specify a new deadline and asks to conduct limited discovery on the employment status of Guiseppe Dimaggio. R. 9. But the status report, R. 10, says that the parties agree to defer any discovery until after the dismissal motion is decided. R. 10 at 3. The tracking status hearing of 01/12/2023 is vacated. A video status hearing to discuss this is set for 01/17/2024 at 10:15 a.m. Members of the public and media will be able to call in to listen to the hearing. Chang: On the government's motion to dismiss as to the United States for lack of exhaustion #4 , the Plaintiff's response is due on 01/05/2024. The government's reply is due on 01/19/2024. This docket entry will be emailed directly to the Plaintiff's counsel, whose contact information appears at R. 2, page 12. The Plaintiff's counsel shall promptly file an appearance on the docket. The Court urges the Plaintiff to consider a voluntarily dismissal and pursuing exhaustion (if still available), if the circumstances dictate. Initial tracking status hearing set for 01/12/2024at 8:30 a.m. to track the case only (no appearance is required, the case will not be called). Instead, the Court will set the case schedule after reviewing the written status report. The parties must file a joint initial status report with the content described in the attached status report requirements by 01/05/2024.
