| Filing 15 MINUTE entry before the Honorable Nancy L. Maldonado: The Court is in receipt of Plaintiff's sealed motion for leave to file exhibits under seal #14 . Plaintiff improperly filed the entire motion under seal on the docket when the appropriate procedure would have been to file the motion itself on the public docket, and to file the materials that are the subject of the motion provisionally under seal in a separate docket entry. This Court is mindful of protecting the public's right of access to judicial records. Also problematic is Plaintiff's failure to comply with this Court's standing order for motion practice, in particular the requirement that all non-dispositive motions indicate whether they are agreed to or opposed by the other party. Plaintiff's statement that it "does not believe Defendant will object to this Motion" does not satisfy this requirement. Defendant has appeared in this matter through counsel, and Plaintiff should have first conferred with Defendant for its position prior to filing. Plaintiff has waited until nearly two months after the filing of the Complaint to seek leave to seal the exhibits and could have waited a little longer to confer with Defendant. Plaintiff's motion #14 is therefore denied without prejudice. Plaintiff may refile the motion with an affirmative statement as to Defendant's position, not just based on belief. The motion should be filed on the public docket, and the exhibits may be filed provisionally under seal as a separate docket entry. (ca, ) |
