Plaintiff is advised that although a motion for leave to amend should be designated as a motion (as plaintiff's most recent motion was designated #30 ), the separate amended schedule A document should not be designated as a motion. Additionally, upon submitting a motion for leave to amend the Schedule A form, plaintiff should submit to the court's proposed order inbox a revised version of any proposed order that is currently pending with the court. Here, since plaintiff has previously submitted a proposed order on plaintiff's motion for a preliminary injunction #21 , plaintiff should submit to the court's proposed order inbox by 1/24/24 a new version of plaintiff's proposed order that has been revised to remove the newly dismissed defendants. The motion reports that plaintiff has settled its claims against two defendants, and it seeks to dismiss those defendants from this action. Given that no defendant has appeared in this case, the court declines to consider plaintiff's motion as an amendment based on the written consent of opposing parties under Rule 15(a)(2). Nevertheless, the court construes plaintiff's motion as a request for leave to amend the pleadings under Rule 15(a)(2) by removing defendants No. 2 renyu2918 and No. 45 YXHM QUEEN from the Schedule A form, and the court grants plaintiff leave to amend the pleadings. Defendants No. 2 renyu2918 and No. 45 YXHM QUEEN are dismissed. Plaintiff has attached an amended Schedule A form to plaintiff's motion [26-1]. Plaintiff is directed to file the amended Schedule A form as a separate entry on the docket by 1/19/24. Plaintiff is advised that to address any similar issues going forward, the most appropriate procedure would be to file a motion for leave to amend the pleadings under Rule 15(a)(2) and to file the amended Schedule A form directly on the docket. Pacold: For the reasons set forth in the motions #7 , #13 , #14 filed by plaintiff Shenzhen Kunshengze Elec-tronic Commerce Co., Ltd., the supporting memorandum #8 , and the temporary restraining order, plaintiff's motions for leave to file certain documents under seal #13 , for leave to file excess pages #14 , and for a temporary restraining order, including a temporary injunction, a temporary asset restraint, expedited discovery, and electronic service of process #7 are granted. Plaintiff's filings support proceeding (for the time being) on an ex parte basis. Specifically, were defendants to be informed of this proceeding before a TRO could issue, it is likely assets and websites would be redirected, thus defeating plaintiff's interests in identifying defendants, stopping defendants' infringing conduct, and obtaining an accounting. In addition, the evidence submitted by plaintiff shows a substantial likelihood of success on the merits (including evidence of active infringement and the offering of products for sale into Illinois), the harm to plaintiff is irreparable, and an injunction is in the public interest. Electronic service of process does not violate any treaty and is consistent with due process because it effectively communicates the pendency of this action to defendants. As other judges in this district have noted, there may be reason to question both the propriety of the joinder of all defendants in this one action and whether plaintiff genuinely intends to pursue an accounting, but at this preliminary stage, plaintiff has provided sufficient evidence of coordinated activity and the prospect of an accounting to justify the requested relief as to all defendants. Expedited discovery is warranted to identify defendants and to implement the asset freeze. If any defendant appears and objects, the court will revisit the asset freeze and joinder. Plaintiff shall deposit with the Clerk of Court ten thousand dollars ($10,000.00), either cash or surety bond, as security. (rao, ) |
