Filing 5 ORDER signed by the Honorable Rebecca R. Pallmeyer on 1/24/2024: Plaintiff's application for leave to proceed in forma pauperis #4 is granted. The court orders the trust fund officer at Plaintiff's place of detention to deduct $20.84 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. The Clerk of Court is directed to send (electronically if possible) a copy of this order to the trust fund officer at Plaintiff's current place of detention and to the court's Fiscal Department. Summons shall not issue, however, and Plaintiff's mandamus petition is dismissed with prejudice as frivolous. This dismissal shall count as a dismissal under 28 U.S.C. 1915(g). Plaintiff is admonished that this is her "third strike" under 28 U.S.C. 1915(g). Her first two strikes were Dyson v. Dart, No. 23 C 416 (N.D. Ill.) (Coleman, J.) (dismissed as frivolous); Dyson v. Oyewole, 23 C 6388 (N.D. Ill.) (Coleman, J.) (dismissed for failure to state a claim). Plaintiff is warned that she has "struck out" under 1915(g), and is further warned that she will not be permitted to proceed in forma pauperis unless she is under imminent danger of serious physical injury. Plaintiff is further warned pursuant to Sloan v. Lesza, 181 F.3d 857, 859 (7th Cir. 1999), that failure to inform the future court of her strike-out status when seeking to proceed in forma pauperis in any future case will result in immediate dismissal of the case. Any pending motions are stricken as moot. The Clerk is instructed to enter a Rule 58 Judgment in favor of Defendants and against Plaintiff. Civil case terminated. Mailed notice (cn). |
