December 7, 2023 Filing 10 MINUTE entry before the Honorable Young B. Kim: In light of the consent, the briefing schedule entered on November 29, 2023, (R. 6), is stricken. Plaintiff's application for leave to proceed in forma pauperis #4 is granted. The government is ordered to file the administrative record by January 29, 2024. The government should not submit a hard copy of the administrative record to chambers until ordered to do so. Plaintiff's motion for summary judgment is due by February 28, 2024. Plaintiff's brief in support of reversing the final agency decision must include a section with a recitation of the relevant facts and a separate section identifying the statement of the issues presented in the brief. The statement of issues must set out a numbered list of issues for the court's consideration. The issue statement must also identify with specificity the aspects of the Commissioner's final decision that Plaintiff challenges, along with a concise explanation of why Plaintiff believes the challenged aspects are unsupported by substantial evidence. The government's response and/or cross-motion for summary judgment is due by March 29, 2024. In the argument section of its response the government must address each issue Plaintiff identifies in his or her brief's statement of the issues. Valderrama: Plaintiff's brief in support of reversing or remanding the decision subject to review is due within 60 days of the filing of the administrative record (no motion required). The Social Security Administration's motion to affirm the decision subject to review and its brief in support are due 45 days after plaintiff's brief is filed. Plaintiff's reply brief, if any, is due 14 days after defendant's brief is filed. No oversized briefs will be allowed without prior court approval obtained at least one week before the due date and upon good cause shown. Additionally, on or before the deadline for the filing of the administrative record, the parties shall file a joint status report in which they indicate (i) whether the parties will agree to consent to the exercise of jurisdiction by a United States Magistrate Judge and (ii) whether they will agree to a voluntary remand to the Commissioner. If the parties consent to the jurisdiction of the Magistrate Judge, they shall execute and file with the Court the joint consent form included as part of the Clerk's Notice previously filed in this case.
