December 28, 2023 Filing 9 ANNUAL REMINDER: Pursuant to #Local Rule 3.2 (Notification of Affiliates)#, any nongovernmental party, other than an individual or sole proprietorship, must file a statement identifying all its affiliates known to the party after diligent review or, if the party has identified no affiliates, then a statement reflecting that fact must be filed. December 13, 2023 Filing 8 MINUTE entry before the Honorable Lindsay C. Jenkins: On review of the complaint, #1 , the Court issues this subject matter jurisdiction inquiry. Plaintiff's complaint states that this lawsuit is filed against Leish Anderson and "unknown occupants (boyfriend)." The complaint states that the case is brought under an Illinois statute, 720 ILCS 5/17-56, which refers to the financial exploitation of an elderly person or a person with a disability. Federal courts are courts of limited jurisdiction. On the Court's review, there is no apparent basis for federal subject matter jurisdiction because it is not clear that the requirements for diversity jurisdiction have been satisfied. The complaint and the attached documents relate to a state law statute, but the Court does not have jurisdiction over a state law statute unless there is diversity among the parties and the amount-in-controversy requirements have been satisfied. The complaint does not address these issues, but the Court must be sure that it has jurisdiction before the case may proceed. Plaintiff must submit a Jurisdictional Statement explaining the basis for federal subject matter jurisdiction by December 27, 2023, or he may file an amended complaint by that date, which explains the basis for the Court's jurisdiction. Otherwise, the case will be dismissed without prejudice. For now, the motion to proceed in forma pauperis and the motion for attorney representation #4 , #5 are denied without prejudice to refiling.
