The Kraft Heinz Co., 23-17095, currently pending before Judge LaShonda Hunt, to this court. The requirements of LR 40.4(a) are met as the cases involve the same issues of law or fact - the same theory of alleged mislabeling - and are filed on behalf of the same set of class members. The two cases also satisfy LR 40.4(b) as they are both pending in this district and judicial efficiency will be served by having them handled by one judge. Both cases were filed in November 2023 and neither has progressed enough to make consolidation impractical. To the contrary, a scheduling order is yet to be set.
