Filing 6 ORDER: Plaintiff Micheal Ray Whitaker's (Plaintiff) application for leave to proceed in forma pauperis #3 is granted. The Court waives the initial partial filing fee and orders the trust fund officer at Plaintiff's place of incarceration to make monthly deductions in accordance with this order. The Court directs the Clerk of Court to send a copy of this order to the trust fund officer at Plaintiff's current place of incarceration and to the Court's Fiscal Department. Summons, however, shall not issue. The Court dismisses Plaintiff's complaint #1 without prejudice for failure to state a federal claim. Plaintiff's failure to submit a proposed amended complaint that complies with this order by February 22, 2024 will result in entry of judgment against Plaintiff. Plaintiff's motion for attorney representation #4 is denied without prejudice. Plaintiff also is advised that he must promptly submit a change-of-address notification if he is transferred to another facility or released. If Plaintiff fails to keep the Court informed of his address, this action will be subject to dismissal without further warning.
