Filing 6 MINUTE entry before the Honorable Nancy L. Maldonado:The Court has reviewed Plaintiff Gardell Delmaro Yancey's application to proceed in forma pauperis (IFP) #3 , motion for attorney representation #4 , and Complaint #1 . The Complaint appears to be identical or very similar to complaints that Plaintiff filed in this District in two other cases that have been dismissed. First, in Case No. 23-cv-3426 at Dkt. 12, Plaintiff filed an Amended Complaint alleging that Plaintiff reported a hate crime, but the police, Illinois Department of Human Rights, and FBI refused to investigate or prosecute it and denied Plaintiff due process of law. That Amended Complaint in 23-cv-3426 was dismissed on 9/13/23 as barred by the statute of limitations and for failure to state a claim upon which relief can be granted. Shortly after that dismissal, on 10/27/23 Plaintiff opened a new case, Case No. 23-cv-15398. Plaintiff's complaint in 23-cv-15398 at Dkt. 1 alleges the same facts in nearly identical language, and on 12/12/23 that complaint was dismissed with prejudice for failure to state a claim. After that second dismissal, on 12/18/23 Plaintiff quickly opened the instant case and submitted a complaint that alleges the same facts, again in nearly identical language. In sum, Plaintiff's complaint has been dismissed twice for failure to state a claim, and in Case No. 23-cv-15398 the complaint was dismissed with prejudice, which means Plaintiff could not file the complaint again. Because Plaintiff's complaint has already been dismissed with prejudice, and again fails to state a claim, this case is dismissed. The IFP application #3 and motion for attorney representation #4 are denied as moot. Civil case terminated. (ca, ) |
