Filing 15 MINUTE entry before the Honorable Franklin U. Valderrama: Before the Court is Plaintiff's motion for leave to use CM/ECF electronic filing #12 . Plaintiff is able to use the electronic filing system provided he has an account. The Court directs Plaintiffs' attention to the U.S. District Court Hibbler Memorial Pro Se Assistance Program, information about which can be found at https://www.ilnd.uscourts.gov/Pages.aspx?/2+UWDbtVzCDq3Lu8BusuQ== or by calling 312-435-5691 for assistance in setting up an account. As Plaintiff does not require Court approval to use electronic filing, the motion is denied without prejudice. Emailed notice (axc). |
Filing 14 MINUTE entry before the Honorable Franklin U. Valderrama: The Court has reviewed Plaintiff's application to proceed in forma pauperis (IFP) #11 and grants Plaintiff's motion. The Court finds that Plaintiff is unable to pay the costs and fees associated with filing this action, and thus, the filing fee is waived. Because Plaintiff has been authorized to proceed in forma pauperis, pursuant to Federal Rule of Civil Procedure 4(c)(3), the Court orders the United States Marshal's office to serve Defendant. Because Defendant has not yet been served, the Court resets the joint initial status report deadline #8 to 04/11/2024. If Defendant has not yet been served as of that date, Plaintiff should file a status report so stating. The Court directs Plaintiff's attention to the U.S. District Court Hibbler Memorial Pro Se Assistance Program, information about which can be found at: https://www.ilnd.uscourts.gov/Pages.aspx?/2+UWDbtVzCDq3Lu8BusuQ== or 312-435-5691. Emailed notice (axc). |
Filing 13 MINUTE entry before the Honorable Franklin U. Valderrama: For the reasons stated in the motion, the Court grants Plaintiff's motion for leave to file his amended IFP #10 . Plaintiff is granted leave to file his amended IFP. Emailed notice (axc). |

Filing 10 MOTION by Plaintiff King J Grace for leave to file Amended IFP. (gcy, ) |
Filing 9 MINUTE entry before the Honorable Franklin U. Valderrama: The Court has reviewed Plaintiff's application to proceed in forma pauperis (IFP) #3 and denies Plaintiff's motion. To determine whether a litigant is indigent, many judges in this district use the United States Health and Human Services (HHS) poverty guidelines (available at https://aspe.hhs.gov/poverty-guidelines). See Newell v. Velacruz, 2017 WL 5905275, at *1 (N.D. Ill. Jan. 26, 2017); Bittman v. Illinois, 2013 WL 120285, at *1 (N.D. Ill. Jan. 8, 2013) (same). The HHS poverty guidelines for 2023 for the 48 contiguous states and the District of Columbia set the poverty level for a household of one at $14,580. Plaintiff's IFP application lists his 12-month income as $32,000. That amount is well above the HHS's poverty threshold. Although Plaintiff lists several debts, including student loan debt, and states that due to recent events his employment is limited, and that business opportunities have been denied due to credit disparities, based on the information included in Plaintiff's IFP application, the Court is not convinced that Plaintiff cannot pay the $402 filing fee. Further, Plaintiff has not included his date(s) of last employment or last monthly take-home pay, as required by the application. As such, Plaintiff's IFP motion is denied without prejudice. By 01/23/2024, Plaintiff must either pay the $402 filing fee or file an amended motion for leave to proceed IFP detailing why Plaintiff's income is insufficient to pay the filing fee, and fully completing the IFP to reflect his date(s) of last employment and last monthly take-home pay. Failure to file an amended IFP application or pay the filing fee by this deadline may result in dismissal of the lawsuit. Emailed notice (axc). |
Filing 8 MINUTE entry before the Honorable Franklin U. Valderrama: On or before 03/11/2024 the parties shall file a joint initial status report. Plaintiff must serve this Minute Entry on all other parties. If the defendant(s) has not been served with process by that date, plaintiff's counsel is instructed to file an individual status report indicating the status of service of process by the same deadline. The parties are further ordered to review all of Judge Valderrama's standing orders and the information available on his webpage. Any nongovernmental corporate party that qualifies under the Rules is reminded of the requirement to file a disclosure statement under Federal Rule of Civil Procedure 7.1/N.D. Ill. Local Rule 3.2. Emailed notice (axc). |
