December 29, 2023 Filing 4 MINUTE entry before the Honorable Nancy L. Maldonado: Plaintiff's application to proceed in forma pauperis (IFP) #3 is denied without prejudice. Title 28 U.S.C. 1915(a) permits the Court to authorize a plaintiff to proceed in forma pauperis if she is unable to pay the filing fee. The statute "is designed to ensure that indigent litigants have meaningful access to the federal courts." Neitzke v. Williams, 490 U.S. 319, 324 (1989). Plaintiff's application indicates that Plaintiff and/or her spouse have received or expect to receive a $26,000.00 settlement or judgment within the last 12 months, have $1,500.00 in a checking or savings account, have a home worth $300,000.00, and have no dependents. Although the application indicates that Plaintiff and her spouse are not employed at this time and have approximately $49,500.00 in debt, the Court finds that the assets listed on the application do not demonstrate indigence. If Plaintiff wishes to proceed with this case, by 1/26/24 she must either pay the filing fee in full or file a renewed IFP application that demonstrates indigence, keeping in mind that the application must be truthful and accurate, or this case will be summarily dismissed.
