Filing 40 MINUTE entry before the Honorable Lindsay C. Jenkins: The Court denied Plaintiff's application to proceed in forma pauperis ("IFP") #3 without prejudice and instructed him to pay the filing fee or reapply for IFP status by January 22, 2024. As of today, Plaintiff has not done so, though he has filed several other motions and letters since the Court requested that he resolve the filing fee. To the extent that Plaintiff's pending mandamus petition in the Seventh Circuit, Appeal No. 24-1085, may impact this Court's jurisdiction, the Court certifies that the mandamus action is frivolous. Cf. Apostol v. Callion, 870 F.2d 1335, 1339 (7th Cir. 1989) ("[A] notice of appeal may be so baseless that it does not invoke appellate jurisdiction."). Mandamus is only appropriate when, among other conditions, "the challenged order is not effectively reviewable at the end of the case." Abelesz v. Erste Grp. Bank AG, 695 F.3d 655, 662 (7th Cir. 2012). The orders Plaintiff challenges, dismissal of a complaint, denial of IFP status, and denial of a motion, are routinely reviewed on appeal, so his mandamus petition does not divest this Court of jurisdiction. This case is dismissed without prejudice for failure to pay the filing fee. All pending motions are terminated as moot. Civil case terminated. Mailed notice. (jlj, ) |

Jenkins: On January 17, 2024, the Court denied Plaintiff's motion for entry of default #20 in part because the Clerk cannot enter a default given the relief Plaintiff seeks and because Plaintiff has not yet resolved the issue of the filing fee #25 . The Court is now in receipt of Plaintiff's January 16, 2024 motion in support of his motion for entry of default, which was not entered onto the docket until today, January 18, 2024 #26 . The motion is denied as moot because the underlying motion has been denied. Further, to the extent that it is a freestanding motion, it is denied because the Court will not grant any form of relief until Plaintiff has paid the filing fee or been granted leave to proceed in forma pauperis. The Court's January 17 order explained that Plaintiff should not file duplicate motions; similarly, Plaintiff should not re-file motions with additional arguments. Litigants are expected to make their arguments in a single filing and should not submit follow-ups with first seeking the Court's permission to do so. The Court realizes Plaintiff filed his most recent motion before the Court issued its January 17 order, so it does not fault him for his January 16 filing. Going forward, however, the Court will not entertain arguments presented in duplicative filings unless the filings explain why Plaintiff could not have made those arguments at the time of his initial filing.
