January 5, 2024 Filing 6 MINUTE entry before the Honorable Matthew F. Kennelly: Brian K. Smith has filed a pro se lawsuit against Ford Motor Company. It appears that Mr. Smith is or was employed by Ford and that he suffered an injury (possibly work-related) somewhere in the 2015-2017 time frame. His lawsuit is filed on a court-provided form for employment discrimination cases and checks off boxes claiming discrimination based on race and disability. Beyond that the complaint form itself says very little. And the attachments are confusing and are not explained by Mr. Smith. For these reasons it is very difficult to determine exactly what sort of wrongdoing Mr. Smith is alleging. Virtually all of the voluminous attachments that Mr. Smith includes with the complaint involve events in the 2015-2017 time frame. If Mr. Smith is complaining of employment-related discrimination during that period of time then his lawsuit was filed far too late and is almost certainly barred by the statute of limitations. The only recent documents attached to Mr. Smith's lawsuit involve an assessment by the IRS for back taxes of approximately $31000 in December 2023. But the Court cannot tell from the complaint or attachments what exactly Mr. Smith contends is wrong with the assessment (if anything). In any event there is an established process that a person must follow to challenge an income tax assessment with the IRS itself before any litigation challenging the assessment may be filed. For these reasons--mainly the fact that the apparently relevant events cited in Mr. Smith's complaint took place in 2015-2017--the Court orders Mr. Smith to show cause in writing by no later than 1/19/2024 why his case should not be dismissed on the ground that it is barred by the statute of limitations. Any document that Mr. Smith files in response to this order should try to explain in a simple and straightforward way exactly what wrongdoing he contends occurred; who did it; and when. If Mr. Smith does not file anything in response to this order the Court may dismiss his case. Mr. Smith's motion for attorney representation #4 is denied without prejudice to renewal because the motion is premature at this time. Mailed notice. (mma, )
