Tharp, Jr: Upon review of the defendant's notice of removal #1 , there is no evident basis for the Court to exercise subject matter jurisdiction over this case. The defendant states that the case, "arises under violation of constitutional laws and Civil right 1983 and Federal question jurisdiction Fair Housing Act, Fair Debt Collection Practices Act. And Fair Credit Report," but the two-page state complaint appears to be a straightforward eviction claim and fails to allege any facts that would give rise to federal question jurisdiction. ECF No. 1 at 3. See Kubiak v. Meltzer, No. 12 c 6849, 2013 WL 1114203, at *1 (N.D. Ill. Mar. 15, 2013) ("An eviction does not arise under the Constitution, law, or treaties of the United States; thus, there is no federal jurisdiction over a state law eviction matter."). Further, neither the notice of removal nor the complaint allege any facts that suggest that this Court has diversity jurisdiction over the plaintiff's claim. Accordingly, the defendant is directed to file a supplement, clarifying the basis for the Court to exercise jurisdiction in this matter, by 01/25/2024.
